Tandoor Morni — Est. 1992 • Effective as of your Order Confirmation date

Important — please read before purchasing. By placing an order on our website, by telephone, or through any Tandoor Morni showroom, you agree to be bound by these Terms & Conditions in their entirety. If you do not agree with any provision, you must not proceed with a purchase. These Terms form a legally binding agreement between you and Tandoor Morni.

Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Tandoor Morni ("Tandoor Morni," "we," "us," or "our"), a commercial tandoor oven manufacturer and retailer founded in 1992 and operating from our principal office in Toronto, Ontario, Canada, with showroom locations across the United States and Canada.

By accessing or using our website (the "Site"), by placing any order for Tandoor Morni products or services, by accepting delivery of any product, or by using any product bearing the Tandoor Morni name, you acknowledge that you have read, understood, and agree to be bound by these Terms, including all policies incorporated by reference.

These Terms apply to all transactions whether initiated online, by telephone, by email, or in person at any Tandoor Morni showroom location. Tandoor Morni reserves the right to modify these Terms at any time. The version in effect at the time of your order confirmation governs your transaction.

Eligibility

You represent that you are at least 18 years of age, possess the legal right and authority to enter into this agreement, and are authorized to use the payment method associated with your order. If you are placing an order on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

Definitions

The following definitions apply throughout these Terms:

  • "Products" means any tandoor oven, accessory, component, spare part, or consumable manufactured by or sold under the Tandoor Morni brand, including Commercial Models (CH-Series, T-Series, CS-Series), Copper Models (A-Series), Home Models (R-Series), and all accessories.
  • "Commercial Products" means any Tandoor Morni tandoor oven designated for commercial food service use, including the CH-Series, T-Series, and CS-Series models and all catering and food truck variants.
  • "Order" means a confirmed purchase of Products placed by a Customer and accepted by Tandoor Morni.
  • "Order Confirmation" means a written or electronic confirmation issued by Tandoor Morni acknowledging receipt and acceptance of an Order.
  • "Delivery" means transfer of physical possession of Products to Customer or Customer's designated carrier.
  • "Installation" means the physical placement, connection, and commissioning of a Product at Customer's premises.
  • "Certified Gas Technician" means a licensed gas fitter or plumber holding current certification under applicable provincial, state, or local law to install and commission commercial gas appliances.
  • "Certifications" means the CSA Sanitation NSF/ANSI 4, CSA Z83.11, and C/US Mark certifications held by designated Tandoor Morni product models.
  • "Easy Financing — Quick Approval" means Tandoor Morni's third-party consumer and commercial financing program, subject to separate lender terms and credit approval.

Orders, Pricing & Payment

Order Process

All orders are subject to acceptance by Tandoor Morni. Submission of an order constitutes an offer to purchase; a contract is formed only upon issuance of an Order Confirmation by Tandoor Morni. Tandoor Morni reserves the right to refuse or cancel any order at its sole discretion, including in cases of pricing error, product unavailability, suspected fraud, or inability to verify payment.

Pricing

All prices listed on the Site or quoted by Tandoor Morni representatives are in United States Dollars (USD) unless otherwise specified. Prices are subject to change without notice prior to Order Confirmation. Applicable taxes, duties, and — for commercial models — shipping charges will be added to your order total as stated in your Order Confirmation.

Free shipping applies to Home Models (R-Series), Copper Models (A-Series), and accessories shipped to addresses within the contiguous United States. Commercial models (CH-Series, T-Series, CS-Series) and international shipments are quoted with separate freight charges.

Payment Terms

  • Payment in full is due at the time of order unless you have been approved for Tandoor Morni's Easy Financing — Quick Approval program.
  • Accepted payment methods include major credit cards (Visa, Mastercard, American Express), ACH bank transfer, certified cheque, and approved financing through Tandoor Morni's lending partners.
  • Tandoor Morni does not store or process credit card information directly. All card transactions are handled by PCI-DSS-compliant payment processors.
  • Financing is offered through third-party lenders and is subject to independent credit approval, lender terms, and applicable interest rates. Tandoor Morni makes no representation regarding financing approval outcomes. The phrase "Easy Financing — Quick Approval" refers to the speed of the application process and does not constitute a guarantee of approval or specific terms.
  • For custom or bulk orders, Tandoor Morni may require a deposit of up to 50% at order placement, with the balance due prior to shipment.

Taxes

Customer is responsible for all applicable sales taxes, use taxes, HST, GST, PST, VAT, customs duties, and import fees associated with the purchase and importation of Products. Tandoor Morni will collect and remit taxes as required by applicable law in the jurisdictions where it is registered to collect tax.

Shipping & Delivery

Shipping Policy

  • Home Models (R26, R28, R32), Copper Models (A02, A04, A06), and accessories ship free to addresses within the contiguous United States. Shipping to Alaska, Hawaii, Puerto Rico, and Canada is available at quoted freight rates.
  • Commercial Models (CH-Series, T-Series, CS-Series) are quoted with shipping charges added to the order. Commercial models ship via freight carrier and require a loading dock or freight elevator, or a liftgate service fee, which is Customer's responsibility to arrange and disclose at the time of order.
  • Tandoor Morni ships from its manufacturing facility and distribution centres. Lead times vary by model and are provided in your Order Confirmation. Standard lead times for in-stock models range from 5 to 21 business days; custom or special-order models may require 6–12 weeks.

Transfer of Risk and Title

Title to Products and risk of loss transfer to Customer upon Delivery — defined as handoff to Customer or Customer's designated carrier at Tandoor Morni's shipping location. Tandoor Morni is not responsible for loss, damage, or delay occurring after Delivery. Customer should inspect all Products upon arrival and note any damage on the carrier's delivery receipt before signing.

Damaged or Missing Items

Any claim for Products damaged in transit or items missing from a shipment must be made in writing to info@tandoormorni.com. Reporting the damage to the delivery driver and obtaining their signature as a witness is required at the time of delivery. Once the driver has left the delivery location, Tandoor Morni is not liable for any damaged products. In-transit insurance is available at extra cost — see Section 4.5 below.

4.5 In-Transit Insurance

In-transit insurance is available at extra cost on every Tandoor Morni oven order. If your oven is damaged during shipping and you have purchased in-transit insurance, Tandoor Morni will handle the insurance claim and replacement process entirely on your behalf. To initiate an insurance claim, contact us within 48 hours of delivery at info@tandoormorni.com or +1 (727) 251-6924 with photographs of the transit damage and confirmation that the damage was reported to the delivery driver and their signature was obtained before they left. Claims submitted without driver sign-off at the time of delivery cannot be processed. Customers who have not purchased in-transit insurance should refer to Section 4.4 above regarding liability.

International Shipments

For shipments to Canada and other international destinations, Customer is solely responsible for compliance with all import laws and regulations, payment of customs duties and brokerage fees, and any delays associated with customs clearance. All Tandoor Morni commercial models carrying the C/US Mark are certified for use in both the United States and Canada.

Warranty

Warranty coverage depends on the product type. Commercial models, copper models, home models, and accessories carry different warranty periods and conditions as described below. All warranties described in this section are the sole and exclusive warranty provided by Tandoor Morni.

5.1 Commercial Tandoor Ovens (CH-Series, T-Series, CS-Series)

Tandoor Morni warrants Commercial Products against defects in materials and workmanship under normal commercial use and service for a period of 6 months from the date of delivery to the original purchaser. During the warranty period, Tandoor Morni will, at its option, repair or replace defective components at no charge, excluding labour costs for on-site service which are Customer's responsibility unless otherwise agreed in writing.

5.2 Home Tandoor Ovens (R26, R28, R32)

Tandoor Morni warrants Home Products against defects in materials and workmanship under normal residential use for a period of 6 months from the date of delivery. This warranty applies to the original purchaser only and is non-transferable.

5.3 Copper Tandoor Ovens (A02, A04, A06)

Tandoor Morni warrants Copper Series Products against defects in materials and workmanship for a period of 6 months from the date of delivery. Natural patination, colour change, and surface variation inherent to copper are not covered by this warranty and are considered normal characteristics of the material, not defects.

5.4 Accessories

Accessories (including skewers, gaddi, ring stands, naan pillows, AS-Series items, and all consumable or wear items) are warranted against defects in materials and workmanship upon arrival only. Any claim for a defective accessory must be made within 7 days of delivery with photographic documentation. Accessories that show signs of normal use, heat exposure, or physical wear are not covered.

5.5 Clay Chamber and Curing Compound

The clay chamber (pot) is a natural ceramic element that requires mandatory curing before use, as described in Tandoor Morni's official curing instructions (Tandoor Oven Curing Paste, AS05, included free with every unit). Clay cracking resulting from:

  • Failure to follow the prescribed curing procedure before first use
  • Exposure to water, rain, or moisture while the clay is at elevated temperature
  • Thermal shock from rapid temperature cycling beyond normal operational parameters
  • Physical impact or improper transport while the clay is warm

…is not covered under warranty. Clay that cracks due to manufacturing defect (verified cracks appearing within the first 30 days of normal operation following correct curing) will be repaired or replaced at Tandoor Morni's discretion.

5.6 Warranty Exclusions

This warranty does not cover:

  • Damage resulting from improper installation, including gas connections made without a licensed Certified Gas Technician
  • Damage resulting from operation outside the specifications in the applicable Tandoor Morni User Manual
  • Damage resulting from use of unauthorized fuel types or fuel pressures outside specified ranges
  • Normal wear and tear, including discolouration, surface oxidation on stainless steel, copper patination, and clay seasoning variations
  • Cosmetic damage that does not affect the operational function of the Product
  • Damage resulting from failure to perform recommended maintenance, including periodic re-seasoning of the clay chamber every 4–6 months
  • Damage caused by modifications, alterations, or repairs not authorized in writing by Tandoor Morni
  • Damage caused by accident, misuse, abuse, neglect, fire, flood, earthquake, or other external causes
  • Products with removed, altered, or illegible serial numbers or certification nameplates
  • Products used in applications or environments for which they are not designed or rated

5.7 Warranty Claims Process

To make a warranty claim, contact Tandoor Morni in writing at info@tandoormorni.com or by telephone at +1 (727) 251-6924 (Monday – Friday, 10 AM – 4 PM, by appointment) with:

  • Your original Order Confirmation number
  • A description of the defect or issue
  • Dated photographic evidence of the defect
  • Confirmation that the curing procedure was followed (for clay-related claims)

Claims are typically reviewed within 2 business days of receiving complete documentation. Warranty decisions are final and at Tandoor Morni's sole discretion.

5.8 6-Month Stainless Steel Body Warranty — All Models

All commercial, copper, catering, and home tandoor ovens come with a 6-Month Stainless Steel Body Warranty.

If the polished stainless steel exterior of any Tandoor Morni tandoor oven is damaged due to a manufacturing defect within 6 months of delivery, Tandoor Morni will repair or replace the affected component at no charge. This warranty covers manufacturing faults only — it does not cover damage from misuse, impact, improper cleaning, or outdoor weathering.

For example, the Restaurant Tandoor Oven CH02 (32x32 inches) ships with a 6-month manufacturing warranty on the stainless steel body. If the polished stainless steel exterior develops a defect attributable to manufacturing workmanship within the warranty period, Tandoor Morni will remedy it at no cost to the Customer under the terms of this warranty.

5.9 Disclaimer of Additional Warranties

THE WARRANTIES SET FORTH IN THIS SECTION 5 ARE THE SOLE AND EXCLUSIVE WARRANTIES GIVEN BY TANDOOR MORNI WITH RESPECT TO ANY PRODUCT. TANDOOR MORNI EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Some jurisdictions do not allow the exclusion of implied warranties, so the above disclaimer may not apply to you in full. In such cases, the duration of any implied warranty is limited to the duration of the applicable express warranty stated in this Section 5.

Returns & Cancellations

Order Cancellations

Orders may be cancelled without penalty within 24 hours of Order Confirmation, provided the Product has not yet entered production or been prepared for shipment. After this window, cancellations may be subject to a restocking fee of up to 25% of the order value, plus any costs incurred by Tandoor Morni in connection with the order. Custom orders are non-cancellable once production has commenced.

Return Policy

  • Unused Products in original packaging may be returned within 30 days of delivery for a refund of the purchase price, less a restocking fee of 15% and any applicable shipping costs.
  • Products that have been cured, fired, or used are not eligible for return. Attempting to return a Product that has been cured or used will be declined, and Customer will be responsible for return shipping costs to retrieve the Product.
  • Commercial models that have been installed and connected to gas supply are not eligible for return under any circumstances, except in the case of a verified manufacturing defect under the warranty provisions of Section 5.
  • Accessories may be returned unused and in original packaging within 14 days of delivery for store credit only. Consumable items (curing compounds, cleaning supplies) are non-returnable.

Return Procedure

To initiate a return, contact info@tandoormorni.com to obtain a Return Merchandise Authorization (RMA) number before shipping. Products returned without an RMA number will be refused and returned to sender. Customer is responsible for all return shipping costs and risk of loss during return transit unless the return is due to a Tandoor Morni error or verified manufacturing defect.

Refunds

Approved refunds will be processed to the original payment method within 10–14 business days of Tandoor Morni receiving and inspecting the returned Product. Tandoor Morni reserves the right to deduct from any refund the cost of any damage, missing components, or missing packaging discovered upon inspection.

Installation, Gas Safety & Operational Responsibility

Gas safety warning. All gas connections to Tandoor Morni products must be made by a licensed Certified Gas Technician. Failure to use a licensed gas professional for gas appliance connections voids all warranty coverage, may violate applicable codes, and creates serious risk of injury, death, and property damage. Tandoor Morni accepts no liability for any loss, injury, or damage arising from improper gas installation.

Customer Installation Obligations

Customer is solely responsible for:

  • Obtaining all required building permits, mechanical permits, gas permits, and health department approvals prior to installation
  • Ensuring that all gas connections are made by a Certified Gas Technician licensed under applicable provincial, state, or local law
  • Installing the Product in compliance with all applicable codes, including NFPA 96, the International Mechanical Code (IMC), and the requirements of the local authority having jurisdiction (AHJ)
  • Providing adequate ventilation, exhaust hoods, and fire suppression systems as required by applicable code and the Product's specifications
  • Performing the mandatory clay curing procedure before first use, as described in the Tandoor Morni User Manual and the instructions accompanying the AS05 Tandoor Oven Curing Paste
  • Re-seasoning the clay chamber every 4–6 months as described in the User Manual
  • Maintaining the Product in accordance with all instructions in the applicable Tandoor Morni User Manual
  • Ensuring that all personnel operating the Product are trained in its safe operation

NSF and CSA Certification Scope

The CSA Sanitation NSF/ANSI 4 and CSA Z83.11 certifications carried by designated Tandoor Morni commercial models cover the equipment design and manufacturing standards at the time of testing. Certification does not constitute a representation or warranty that the Product will pass any specific inspection in any specific jurisdiction, as local authority having jurisdiction requirements may impose additional standards. Customer is responsible for verifying compliance with local AHJ requirements prior to installation. Tandoor Morni will provide certification documentation on request within one business day.

Approved Fuel Types

Tandoor Morni gas products are designed and certified for use with natural gas or liquid propane (LP) as specified on the Product label and in the User Manual. Use of any other fuel type, or use at fuel pressures outside the specified range, is strictly prohibited, voids all warranty coverage, and is Customer's sole responsibility.

Charcoal Operation

Charcoal-fuel capable Tandoor Morni models must only be operated with lump hardwood charcoal or briquettes in open, well-ventilated outdoor or appropriately ventilated commercial kitchen environments. Operation of charcoal tandoor ovens in enclosed spaces without adequate ventilation creates carbon monoxide risk. Customer is responsible for complying with all applicable air quality regulations, including restrictions imposed by local Air Quality Management Districts (AQMD) in California and other regulated jurisdictions.

Limitation of Liability

8.1 Limitation of Direct Damages

IN NO EVENT SHALL TANDOOR MORNI'S TOTAL LIABILITY TO CUSTOMER FOR ANY CLAIM ARISING OUT OF OR RELATED TO ANY PRODUCT OR THESE TERMS EXCEED THE AMOUNT ACTUALLY PAID BY CUSTOMER FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8.2 Exclusion of Consequential Damages

TANDOOR MORNI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION: LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITY, LOSS OF GOODWILL, BUSINESS INTERRUPTION, LOSS OF DATA, OR COSTS OF REPLACEMENT EQUIPMENT, EVEN IF TANDOOR MORNI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.3 Essential Basis

The parties acknowledge that the limitations of liability set forth in this Section 8 are an essential element of the agreement between the parties, and that Tandoor Morni would not have entered into this agreement without such limitations. The limitations shall apply regardless of the theory of liability, including contract, tort, strict liability, negligence, or any other basis.

8.4 Statutory Rights

Some jurisdictions — including certain Canadian provinces — do not permit the exclusion or limitation of consequential or incidental damages, or impose minimum consumer protection standards that override contractual limitations. In such jurisdictions, the above limitations shall apply to the maximum extent permitted by applicable law, and nothing in these Terms shall be interpreted to deprive you of any non-waivable statutory rights.

8.5 Indemnification

Customer agrees to defend, indemnify, and hold harmless Tandoor Morni and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

  • Customer's violation of these Terms
  • Customer's improper installation, operation, or maintenance of any Tandoor Morni Product
  • Customer's failure to obtain required permits or approvals
  • Gas connections made by anyone other than a Certified Gas Technician
  • Customer's use of any Product in a manner not intended or recommended by Tandoor Morni
  • Any third-party claim arising from Customer's use of any Product

Intellectual Property

Ownership

All content on the Tandoor Morni website and in all Tandoor Morni marketing materials, user manuals, product documentation, and branded assets — including but not limited to text, photographs, product designs, logos, trademarks, trade names, and technical specifications — is the exclusive property of Tandoor Morni or its licensors and is protected by applicable copyright, trademark, patent, and other intellectual property laws in Canada, the United States, and internationally.

The Tandoor Morni name, logo, and all product names are trademarks or registered trademarks of Tandoor Morni. You may not use any Tandoor Morni trademark, trade name, or product name in any manner that could cause confusion or imply endorsement without prior written permission.

Limited Licence for Personal Use

Tandoor Morni grants you a limited, non-exclusive, non-transferable, revocable licence to access and use our website for your personal, non-commercial use of browsing and purchasing Products. This licence does not include the right to:

  • Reproduce, distribute, modify, or create derivative works of any Tandoor Morni content
  • Use any Tandoor Morni content for commercial purposes without prior written consent
  • Scrape, crawl, or systematically extract data from the Site
  • Use the Site in any way that could damage, disable, or impair its operation

User Content

If you submit any review, photograph, testimonial, or other content to Tandoor Morni through the Site, by email, or through any social media channel in connection with Tandoor Morni's products, you grant Tandoor Morni a perpetual, worldwide, royalty-free licence to use, reproduce, modify, and distribute that content for any purpose, including marketing and promotional use, without compensation to you.

Privacy & Data

Tandoor Morni collects, uses, and protects your personal information in accordance with its Privacy Policy, which is incorporated into these Terms by reference. By purchasing from Tandoor Morni, you consent to the collection and use of your personal information for the purposes described in the Privacy Policy, including order processing, warranty administration, and communications regarding your Products and Tandoor Morni's offerings.

Canada
Tandoor Morni complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, including Ontario's privacy requirements. Customers in Canada have the right to access, correct, and request deletion of their personal information as provided under applicable law.
United States
Tandoor Morni complies with applicable US federal and state privacy laws. California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to delete personal information, and the right to opt out of sale of personal information.

Tandoor Morni does not sell your personal information to third parties. Your information may be shared with service providers (payment processors, shipping carriers, financing partners) as necessary to fulfil your order. Governing Law & Dispute Resolution

Governing Law

These Terms and any dispute arising out of or in connection with these Terms or any Tandoor Morni Product shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the applicable federal laws of Canada, without regard to its conflict of law provisions.

Canadian Customers
Customer irrevocably submits to the exclusive jurisdiction of the courts of Ontario, Canada for the resolution of any dispute. Nothing in this section prevents Tandoor Morni from seeking injunctive or other equitable relief in any jurisdiction.
US Customers
US customers consent to personal jurisdiction in Ontario, Canada, and agree that any dispute shall be resolved in Ontario courts. Nothing in these Terms limits the applicability of any mandatory consumer protection laws of your state that cannot be waived by contract.

Informal Dispute Resolution

Before initiating any formal legal proceeding, Customer agrees to first contact Tandoor Morni in writing at info@tandoormorni.com and allow Tandoor Morni 30 days to attempt to resolve the dispute informally. This informal notice requirement does not apply to claims for injunctive relief or emergency relief.

Class Action Waiver

To the fullest extent permitted by applicable law, any dispute resolution proceeding shall be conducted on an individual basis only, and not as a class action, class arbitration, or representative action. You waive any right to bring or participate in any class-wide proceeding.

Time Limitation on Claims

Any claim or cause of action arising out of or related to these Terms or any Product must be brought within 6 months after the claim or cause of action arose, regardless of any longer limitation period that may be applicable under governing law. Failure to bring a claim within this period constitutes a waiver of that claim.

General Provisions

Entire Agreement

These Terms, together with your Order Confirmation, the applicable Tandoor Morni Privacy Policy, and any warranty documentation provided with your Product, constitute the entire agreement between you and Tandoor Morni with respect to your purchase and supersede all prior agreements, representations, and understandings, whether oral or written.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity or enforceability of the remaining provisions.

Waiver

Tandoor Morni's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Tandoor Morni to be effective.

Assignment

You may not assign or transfer your rights or obligations under these Terms without Tandoor Morni's prior written consent. Tandoor Morni may assign these Terms or its rights hereunder without restriction, including in connection with any merger, acquisition, or sale of substantially all of its assets.

Force Majeure

Tandoor Morni shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, government actions, labour disputes, supply chain disruptions, port closures, carrier delays, or civil unrest. In such events, Tandoor Morni will provide reasonable notice and use commercially reasonable efforts to resume performance as soon as practicable.

Language

These Terms are written in English. If they are translated into any other language, the English version shall govern in the event of any conflict or ambiguity.

Changes to Terms

Tandoor Morni reserves the right to modify these Terms at any time by posting revised Terms on our website. The Terms in effect at the time of your Order Confirmation govern your transaction. We encourage you to review these Terms periodically. Continued use of the Site after any modification constitutes your acceptance of the revised Terms.
